JAARA BRINGING THEM HOME CAMP MOVES TO SOS BEFORE HEADING HOME AGAIN!

(scroll dowm for the new media release)

The Jaara Bringing Them Home Camp has not been defeated, in spite of its removal by the Department of 'Sustainability and Environment'.

The Department, crown representatives, arrested Aunty Susan Rankin and removed the camp from Franklinford.

The Department of Sustainability and Environment has not come up with any formal documents of Jaara sovereignty being ceded. Under natural law and justice, and international law, it is the Department of Sustainability and Environment that is the trespasser.

Susan states: “I am not the trespasser here, until DSE and all levels of Australian Government produce documents of consent to occupy our lands or engage in a much needed treaty process, they are the trespassers”.

The Bringing Them Home Camp is coming to SOS, and is calling out for people to join them after SOS and restablish our presence in Franklinford.

MEDIA RELEASE

8TH July 2004

JAARA BRINGING THEM HOME BROKEN UP BY POLICE

WHY NO CHARGES LAID?

On Monday the 5th July, the Jaara Bringing Them Home Camp, established

at Franklinford Crown Reserve was closed by the Daylesford police (see:http://www.country-liberal-party.com/pages/Jaara-Going-Home-Camp.htm).

The police acted from the instruction of the Department of Sustainability and Environment (DSE), who read an immediate eviction notice to camp residence.

Since its establishment on Sorry Day (26th May) the camp has been running successfully; bringing many visitors to the site and educating people on a range of historical and contemporary Aboriginal issues. The breakup of the camp is yet another story of dispossession and genocide of Aboriginal people, which has ironically occurred at the beginning of NAIDOC week – a week of celebration and sharing of Aboriginal survival and culture.

Locals of Franklinford and opponents to the camp gathered to watch, as the camp members peacefully packed away their belongings. Jaara descendant Susan Rankin refused to leave the site and was carried out by police and arrested under the guise of trespass.

As soon as Susan was removed, Franklinford residents entered the site and changed the locks on the hall.

Susan states: “I am not the trespasser here, until DSE and all levels of Australian Government produce documents of consent to occupy our lands or engage in a much needed treaty process, they are the trespassers”.

Like other Aboriginal elders, Australia wide, Susan has been asking DSE, the Premier’s office and the federal government to produce the formal written documents of consent to occupy Aboriginal homelands. DSE is the only department to formally respond and could not produce and such documents and doubts “if indeed they exist”. Without these documents,

the jurisdiction of all levels of government remains void. The invasion of any country without consent or treaty is against international law and suggests an act of aggression and a declaration of war. If Susan had
been arrested this issue would have been raised in the Magistrate Court.

Susan asks: “If I am seen as such a criminal, trespassing on my own land then why wasn’t I charged? Where is this current government’s formal
written document of consent of the Jaara people to the occupation of Jaara lands? Where is the treaty or treaty process? I believe I am not being charged because DSE know I want to take these important questions to court. Given the circumstances anyone else would have been charged with trespass. Are the authorities admitting there are special rules for Aboriginal people?”

Susan Rankin and her supporters were asked not to return to the reserve site, although DSE could not give clear indication of where these boundaries were and would not produce a written copy of the eviction notice, warrants for arrest or charge sheets.

“As a Jaara descendant who has never ceded my sovereignty, I am not a trespasser. I will be returning to Franklinford because it is my birthright and it is a place of huge spiritual, historical and cultural importance. I am spreading the word about this unjust situation and will
be notifying the media in advance regarding future actions to reclaim my sovereign rights, which for too long have been denied and oppressed”.
